I live in California, and I’m in a same-sex relationship. I’m planning to buy a house myself (with only me on the title and loan), and my boyfriend is planning to move-in with me. I don’t plan to charge him rent or anything.

If we live together long enough, do we automatically become common-law partners, or domestic partners, even without any formal legal registration? If we were to break-up, would I ever be liable to pay him any sort of alimony, and would he ever have any rights to my property?

Sorry if this question is strange, but I’ve heard enough horror alimony/divorce stories to get nervous about everything.

An Orange county man and his wife were married for 18 years until their divorce in 2004. During this time, they owned and managed a real estate company together. 18 years and 2 children later, the husband has accepted his former wife as a lesbian, and that she was moving in with her new lover.

In the process of the divorce, he agreed to pay $1,250 per month in alimony. She did not, however, reveal that she and her new lover were now registered as domestic partners.

Should this man still have to pay alimony?

Is this a case of the wife wanting her $1,250 per month cake and GETTING to eat it, too?

Do you think it has an impact on the gay rights/marriage issues when a person enters a same-sex relationship while still reaping rewards of their marriage?

kayer_fire: So, you stance is that as long as congress is against gay marriage, the husband (in this case) should have to be financially held accountable for their decision, even though HE IS accepting of his ex- wife’s new relationship?
This took place in Orange County here in Southern California; one of the few states to recognize same-sex relationships on ANY level.
LOL… No. I’m not the husband.

There are at least 1,049 protections, benefits & responsibilities extended to married couples under Federal law, according to a 1997 study by the General Accounting Office. Gay & lesbian couples pay higher taxes and are denied basic protections under the law.

They receive no Social Security survivor benefits upon the death of a partner, despite paying payroll taxes. They must pay Federal income taxes on their employer’s contributions toward their domestic partner’s health insurance (married employees do not have to pay such taxes for their spouses).

They must pay all estate taxes when a partner dies. They often pay significant tax penalties when they inherit a 401(k) from their partner. They are denied family leave under the Family and Medical Leave Act.

CIVIL UNIONS DO NOT PROVIDE ANY OF THESE RIGHTS. And under current Federal law, neither will state-permitted same-gender marriages.

Isn’t this Heterosexual Privilege? How is Gay Marriage a “special right”?
I have provided information so that people can respond to the QUESTION with some intelligence and information. It was clear from my earlier question that people were ill informed. This IS a question, and is meant to be so.
The reason I have posted this question in the R&S section is because the largest majority of people who oppose gay marriage do so on religious grounds. They pretend there is no cost to this opposition. Religion is costing American same-gender couples millions of dollars each year, money that straight couples never have to pay.
